Una de las qüestions més importants a les quals ha de fer front la ICCAT es el no respecte per part de las Parts Contractants (CPC) de les mesures adoptades per la Comissió. La 21 reunió ordinària d’ICCAT obre, precisament, amb dos díes sencers dedicats exclusivament a l’anomenat Comitè de Compliment (de les normes). Adjunto a continuació un extracte de l’informe que estic preparant en relació a aquest aspecte:
(ES) No es sólo un problema de normas insuficientes, sinó de que éstas no se cumplen o no se hacen cumplir
Una de las cuestiones más importantes a las que se enfrenta ICCAT ha sido la ausencia de cumplimiento por parte de las Partes Contratantes (CPC) de las medidas adoptadas por la Comisión. La 21 reunion ordinaria de ICCAT se abre, precisamente, con dos dias enteros dedicados exclusivamente al llamado Comité de Cumplimiento. Se trata uno de los ejercicios más importantes de la 21 reunión ordinaria. Este es el momento en que las Partes exponen lo que consideran que son, o pueden ser, infracciones de otras Partes, y entonces las Partes señaladas deben explicar si la ‘acusación’ es cierta, y qué han hecho para remediarla. Las acusaciones son de todo tipo, y suelen proceder de denuncias hechas por parte de ONG, inspectores de los Estados Miembro, etc. Se trata de un barco que no contaba con la documentación a bordo, una transferencia en alta mar que no había estado debidamente enregistrada en vídeo, una captura que no ha sido convenientemente documentada o que no cuenta con los formularios adecuados, un barco que ha pescado fuera de zona, fuera de temporada, o cantidades superiores a las permitidas, barcos con ‘pabellón de conveniencia’, llegando hasta la inacción o directamente la complicidad de algunos gobiernos, o miembros del gobierno, en dichas infracciones. A título de anécdota, los periódicos argelinos divulgaron recientemente que 210 toneladas de atún rojo habían sido pescadas ilegalmente en aguas argelinas por un barco turco Akuadem II. Según dichas fuentes, está en curso una investigación y un juicio en Argel para determinar el grado de responsabilidad del grupo acusado, formado por armadores argelinos y turcos, así como dos funcionarios de alto nivel del ministerio de pesca argelino.
Este año, Turquia parece concentrar la mayor parte de las denuncias. Son numerosas las delegaciones que los señalan como infractores. El Delegado turco se esfuerza en dar explicaciones sobre ciertas acusaciones, pero no parece tener todas las respuestas. Los informes del barco de la Marina francesa, Arago, es una de las fuentes más citadas. Sus informes son de la campaña de Atún de 2009. En concreto, se señala que los cerqueros turcos investigados no contaban con observadores ICCAT, las declaraciones de transferencia nunca contenían toda la información requerida, ningú barco turco pudo presentar una autorización de transferencia, las capturas declaradas se encontraban claramente por debajo de las realmente realizadas, etc…
No sólo Turquia se ve señalada. También según la misma fuente, el Navío Arago, se señala que algunos de los video de las transferencias realizadas por cerqueros españoles hechos durante la noche son del todo inútiles para el objetivo por el que son obligatorios: facilitar que se pueda contar las transferencias. Así mismo, se señala que un cerquero griego, Apollon, ha sido claramente usado para obtener quota en beneficio del Grupo Turco Akua, que regenta una granja de engorde en Grecia.
En otras palabras, la situación és altamente preocupante. El descontrol y la falta una cultura de de cumplimiento de las normas es evidente. Sobre la mesa hay algunas propuestas para establecer un sistema de sanciones o de penalización via puntos (similar al sistema de control recientemente adoptado por la UE). No obstante mi percepción és que, en realidad, la dificultad y la falta de mecanismos reales, creibles y efectivos para hacer cumplir las normas hacen que algunos seamos muy escépticos ante la posibilidad que la situación mejore a corto plazo. Ante ese escenario, sólo el cierre temporal de la pesquería, o al menos la prohibición de las exportaciones internacionales (listar Atún Rojo en Apéndice I de CITES), permitiría controlar y revertir el enorme daño que dichas malas prácticas están haciendo al estoc.

The accusations are of all types, and usually come from accusations made by an NGO or a Contracting Party, based on observations by their inspectors. From a boat that did not have on board the relevant documentation, a transhipment on the high seas that had not been properly registered in video, a catch that has not been properly documented, a boat that has fished outside zone, outside season, or amounts above the allowed quotas, boats with ‘flag of convenience’, up until the inaction or direct complicity of some governments, or members of the government, in these infractions. Just one anecdote, recently Algerian newspapers reported 210 tonnes of illegaly caught bluefin tuna in Algerian waters by the Turkish vessel Akuadem II. According to the sources, a trial is currently taking place in Algiers to determine the fate of the accused group of Algerian and Turkish shipowners, as well as two high-level officials from the Algerian Ministry of Fisheries.
This year, so far, Turkey seems to be attracting most of the denunciations. Several delegations indicate that there are violations. The Turkish Delegate strives in giving explanations on certain accusations, but it does not seem to have all the answers. The information of the boat of French Navy, Arago, is one of the most cited sources. Their information relates to 2009 Campaign of Bluefin Tuna. In particular, it is indicated that the investigated Turkish purseiners did not have ICCAT observers, the transfer declarations did not contain all the required information, no Turkish boat could display a transference authorization, the declared captures were clearly far below those really realised, etc…
Not only Turkey is criticised. Also according to the same source, the Arago, some of the videos of the transhipments made by Spanish purse seiners during the night are absolutely useless for the reason they they are required: to facilitate the counting. Also, it is indicated that a Greek purse seiner, Apollon, clearly has been used to obtain quota to the benefit of the Turkish Group Akua, that runs a farm in Greece.
In other words, the situation is highly worrisome. The uncontrol and the lack of a culture of fulfillment of the rules, or compliance, is evident. On the table there are some proposals to establish a system of sanctions or points system (similar to the one recently adopted in the EU under the Control Regulation). Neverthless, my perception is that, in fact, the difficulty and the lack of real, conceivable and effective mechanisms to apply the rules make some of us very skeptical about the real possibility that the situation can be improved in the short term. Thus, only a temporary closing of the fishery, or at least the prohibition of the international trade (which would mean listing Bluefin Tuna in Appendix I of CITES), would allow the stock to recover from the enormous damage that these bad practices are causing.
