Ara fa unes setmanes vaig tenir ocasió de convidar a Brussel.les una nodrida i més que interessant delegació de persones representatives d’entitats LGBT de Catalunya i de la resta de l’Estat. Un cop més es va posar de manifest com de lluny es troba la T (Transexual i Transgènere) de la resta de sigles, especialment la G (Gai) i la L (Lesbiana) en termes de protagonisme polític, social i mediàtic. Ja fa temps que des de l’Intergrup pro Drets LGBT del Parlament Europeu avaluem el tema i ens hem compromès a fer diverses iniciatives al respecte. Una d’elles és la pregunta que aquest mes de gener dirigeixo a la Comissió, de manera prioritària, en relació a la Implementació de la Directiva 2006/54/EC sobre ‘reassignació’ de gènere en relació a les persones transgènere. Implementation of 2006/54/EC Gender ‘Recast’ Directive vis-à-vis transgender people
As guardian of the Treaty of the European Union, the European Commission has a key role to play in checking the proper implementation of the Directive 2006/54/EC also known as Gender ‘Recast’ Directive.
It has been brought to our attention, however, that the Directive has not been properly implemented in most EU Member States when it comes to its applicability to transgender people, as indicated in the “Homophobia and Discrimination on Grounds of Sexual Orientation in the EU Member States Part I – Legal Analysis” published during June 2008 by the Fundamental Rights Agency.
This report indicates that in at least 11 Member States “transgenderism is treated neither as sex discrimination not as sexual orientation discrimination, resulting in a situation of legal uncertainty as to the precise protection of transgender persons from discrimination.” (p. 126)
What will the European Commission do to ensure that Member States fully implement the Directive?
Will it bring any infringement procedure on this Directive?
