Memoràndum: i els culpables, què?

Una vegada conegut el contingut del Memoràndum de rescat a l’Estat espanyol, i coneixent per tant les inconsistències del mateix (especialment preocupant és constatar que en cap cas es preveu que els veritables culpables de la crisi siguin els qui en paguin les conseqüències, ans al contrari), són nombroses les preguntes per al Consell i la Comissió en relació a les eventuals conseqüències de la seva implementació.

Avui n’he presentat algunes, amb caràcter prioritari:

En referència a la proposta de Memoràndum per al rescat d’Espanya, sobretot pel que fa a l’Annex 2 sobre les condicions, voldria fer les preguntes següents.

En els punts 5 i 10, s’imposa la creació de Subordinated Liability Exercices, és a dir ‘quitas’ en passius subordinats perquè assumeixin pèrdues, la qual cosa afectaria als estalviadors estafats amb el negoci de les “participacions preferents”. Adicae calcula que un 8% de la població espanyola està involucrada en accions preferents i subordinades. El punt 29 només limita aquest tipus de pràctiques, sense demanar processos judicials que determinin els culpables de les estafes. Creu el Consell/la Comissió que és just que les persones estafades assumeixin també les pèrdues de l’especulació bancària?

En relació a la creació d’una “Asset Management Company” (7 i 15), no es determina qui assumirà finalment les pèrdues dels actius tòxics col·locats en l’AMC, ni quin serà el control democràtic a què està sotmesa aquesta mesura. Fora del MoU es determina que 25.000 milions d’euros del rescat aniran destinats a aquesta AMC, i aquest deute serà assumit directament per la ciutadania espanyola. Per què el MoU no proposa un AMC amb control democràtic que garanteixi la salubritat bancària i la no socialització de les pèrdues?

La vinculació entre el sector financer i l’immobiliari és la causa principal de la crisi espanyola. El MoU proposa només revisar els problemes de concentració de crèdit i les transaccions amb parts relacions (punt 28). Per què no es fa cap proposta de canvi del marc legislatiu espanyol per acabar amb aquest cercle viciós?

El punt 14 fa referència a la revisió interna. Per què el MoU no exigeix la creació d’una regulació espanyola i europea per evitar que els banquers segueixin especulant amb els diners dels estalviadors?. A més, creu el Consell/la Comissió que la bancarització definitiva de les caixes (punt 18), eliminat la seva obra social, contribuirà a que les finances tornin a servir a l’economia real ia la societat? Així mateix, a escala transversal es proposa la fusió de bancs del grup 2 i 3, però això no és incompatible amb el principi de “too big to fail, too risky to exist”?

Finalment: Per què el MoU no afronta aspectes tan claus sobre, per exemple, el sistema de presa de decisions per limitar el risc, la desvinculació del sector financer de l’immobiliari, la necessitat d’un major escrutini i independència del Banc d’Espanya, o la necessitat de determinar les responsabilitats als culpables?

Estalvi energètic: pensem’hi i actuem ara, abans no sigui massa tard

Fa anys, quan algunes veus reclamàvem, en clara minoria, una major i millor regulació del sector econòmic i financer, molts dels qui ara governen (per què van guanyar diverses eleccions, alguns amb majoria absoluta) se’ns reien a la cara. Si haguéssim actuat abans, i a fons, potser no estaríem on som ara.

La mirada curta que predomina avui en la majoria de les opcions polítiques, però també en l’exercici de la comunicació i la informació, fa que tinguem societats amb poca capacitat de mirar-se les coses amb perspectiva intergeneracional i multidimensional. I això és un problema, per què ens porta a una política que, enlloc de prevenir i evitar l’esclat de crisi, es limita a reaccionar-hi i surfejar-les.

En aquest sentit, cal recordar que darrera les catàstrofes econòmica i política (democràtica) n’hi ha una altra que, malauradament, sembla haver passat en segon pla, però que segueix essent crucial: la climàtica, i més concretament l’energètica. A tall de recordatori voldria esmentar una de les votacions més importants la setmana passada a Brussel·les, en el marc de la Comissió d’energia (ITRE), en relació a l’estalvi energètic.

La legislació en curs (ja ha superat tràmit a la Comissió ITRE i ara caldrà esperar resultats del trílog i votació en plenària) inclou un seguit de mesures crucials en favor de l’estalvi energètic. Per exemple, els Estats membres hauran d’establir un full de ruta l’objectiu del qual sigui aconseguir un estalvi energètic del 80% al sector de la construcció el 2050. Així mateix, s’exigirà a les empreses energètiques que es facin responsables de l’estalvi anual fins a un 1,5% en relació a tots els sectors d’ús final (tot i que aquesta mesura va quedar considerablement aigualida per culpa de les intervencions governamentals). Un altre paquet de mesures són els anomenats instruments financers de caràcter obligatori, i una millor informació de cara a les persones consumidores (p.e. a través de l’ús de comptadors intel·ligents), igual com mesures destinades a reduir la demanda.

Mentre alguns (PP, però també la socialdemocràcia) aposten per allargar la vida a les centrals nuclears, d’altres insistim que allò que cal és un canvi radical en el model de generació i consum energètic, posant especial èmfasi en l’estalvi.

El ponent de l’informe, en aquest cas el meu col·lega verd luxemburguès, Claude turmes, va fer un extraordinari treball per acostar Europa al compliment dels objectius 2020 (veure nota al peu 1), però va advertir que encara queda molt per fer per tal que la UE compleixi el seu objectiu de reduir el consum d’energia un 20% per aquell any 2020, així com també va subratllar la necessitat d’afrontar les evidents mancances i falles existent en l’esquema de comerç d’emissions de la UE. Després de la votació, el mateix Claude Turmes va dir:

 

“Today’s vote brings us a step closer enacting this essential legislation, which will give a boost to Europe’s economy and help achieve our energy security and climate goals. The new energy efficiency directive enshrines the EU’s 20% energy savings target in a legal framework and sets out binding measures (1), which will go a significant way towards bridging the current gap the EU is facing with regards to meeting its pledge to reduce energy consumption 20% by 2020. However, clearly more needs to be done to fully close the gap. Realising the EU’s energy saving target not only makes sense in terms of meeting our energy security and climate change goals, it also makes broader economic sense, stimulating economic activity and creating millions of jobs, whilst bringing down energy bills for businesses and households, and our dependence on energy imports.

“While the new energy efficiency legislation represents a major step forward for EU climate policy, it has added to the urgent need to address the problems with the misfiring emissions trading scheme. The carbon market is clearly in need of regulative intervention in order to address the oversupply of emissions permits and the resulting excessively low carbon price. While the Commission committed to do this in the context of negotiations on the energy efficiency directive, it must  come forward with proposals to address the oversupply of emissions allowances and the unrealistically low carbon price before the summer. As a first step, this means limiting forthcoming auctions of emissions permits. However, ultimately, the Commission will have to completely retire an amount of emissions permits. The sooner this is done, the better.”

Romania posa en escac la UE

Victor Ponta, el primer ministre de Romania, ha impulsat mesures de dubtosa legalitat, i posa en escac l’Estat de dret dins la UE (veure aquesta notícia). Ponta va ser ahir al Parlament Europeu, on es va reunir amb el President, Martin Schulz, i avui s’ha de veure amb els presidents de la Comissió (Barroso) i del Consell Europeu (Van Rompuy).

El Grup Verds/ALE al PE ens hem fet ressò d’aquesta visita, i hem fet manifest la nostra preocupació davant del retrocés democràtic que ha tingut lloc a Romania, arran de la recent utilització de decrets d’emergència pel primer ministre Victor Ponta per alterar les institucions democràtiques.

La Comissió Europea ha d’avaluar la situació i, en particular, ha de tenir en compte els últims avenços en una propera avaluació sobre els progressos realitzats després de l’adhesió democràtica que es presentarà al Consell de la Unió Europea de Ministres de la setmana.

Aquesta és la nota que hem emès, com a grup, signada pels dos co-presidents, Dany Cohn-Bendit i Rebecca Harms:

“We are alarmed by the general situation in Romania and the recent moves to undermine democratic institutions by Victor Ponta and his government. Romania committed to EU values concerning democracy and the rule of law when it joined the European Union five years ago and this commitment remains just as important now as then.

“The European Commission was tasked with monitoring developments in Romania following its accession and these worrying developments underline the need for the Commission to continue this task. The forthcoming assessment report to the Council by the Commission must not gloss over the democratic problems in Romania that have emerged in recent weeks. It is crucial that this report includes all the latest developments and that the Council responds to any concerns raised.

“The European Parliament, for its part, must follow-up with its own assessment through the relevant committees ahead of a plenary debate on the issue scheduled for September. This implies sending a fact-finding mission to Romania to assess the respect of democratic values and the rule of law.

“It is crucial that threats to democracy in EU member states are treated as priorities for the Union as a whole, and that we do not become bogged town in a tit-for-tat between centre-left and centre-right political families.”

Totes i tots som Unitat contra el feixisme i el racisme

“És evident que la crisi comporta un augment de l’extrema dreta arreu d’Europa, especialment amb el Front Nacional a França i, encara pitjor, amb l’Alba Daurada a Grècia.

A Catalunya, aquest perill també hi és present. Però aquí podem celebrar els avenços d’Unitat Contra el Feixisme i el Racisme (UCFR). Aquest moviment unitari va contribuir al fet que el partit d’extrema dreta, Plataforma per Catalunya (PxC) —que dóna suport a l’Alba Daurada — no aconseguís cap escó a Madrid, el novembre passat. Això ho va reconèixer el propi Josep Anglada, històric franquista i actualment líder de PxC, amb insults i amenaces contra UCFR.

L’arribada del centre nazi al Clot ha empitjorat la situació. Es disfressa d’un centre d’oci per a joves, però sabem que l’impulsen militants de PxC, així com altres nazis i falangistes descarats. Sabem que des que va aparèixer, hi ha hagut un augment d’adhesius i pintades nazis al barri. Després de l’èxit de la manifestació ciutadana contra el centre nazi, impulsada pel grup local d’UCFR, hi ha hagut agressions contra locals de grups progressistes.

Els feixistes titllen UCFR d’entitat violenta. En realitat, com es pot veure al seu web, UCFR la formen centenars d’entitats molt diverses, que van des d’una associació de familiars de víctimes dels camps nazis fins al conjunt del moviment sindical. Pot semblar estrany que els feixistes ataquin així les federacions d’esplais i escoltes; les ONGs de solidaritat o d’acció social; el Festival de Cinema Jueu de Barcelona i les associacions gitanes… totes elles entitats adherides a UCFR. Però s’entén perfectament si es recorda que els nazis van prohibir tots els espais de lleure del jovent, imposant les joventuts hitlerianes; i que van dissoldre totes les ONGs en una única organització nazi. I com sabem, la població jueva i gitana, entre altres, van acabar als camps d’extermini.

Amb els seus atacs, els feixistes demostren què representen realment.

No només ataquen UCFR en general, sinó que també ataquen personalment alguns dels seus activistes. És molt revelador contra qui dirigeixen el seu odi.
Un d’ells és conegut com a activista gay. Els feixistes l’han titllat de “guarra”, “travelo”, etc.

L’altre objectiu especial de l’odi dels feixistes és una persona que se sap que té ascendència amaziga.

A l’atacar aquestes persones potser pensen que les poden aïllar. Potser pensen que la resta direm “doncs no comparteixo tal o qual opinió seva”, o “s’ho han buscat”. Doncs no serà així. UCFR és un espai plural, amb persones de visions diferents. Però on sí coincidim és en oposar-nos al feixisme i el racisme, i quan ataquen a aquests individus, i a UCFR en general, pel fet d’impulsar la lluita unitària i ciutadana contra l’extrema dreta, ens ataquen a cadascú de nosaltres.
El pla de rescat de l’Estat espanyol fa més urgent que mai aturar l’extrema dreta. El país que més retallades ha vist és Grècia, i no és casualitat que sigui aquest país el que ha vist l’augment més ràpid d’un partit nazi.

Fa molts anys, el Pastor Niemöller, víctima dels nazis, va dir:          

Primer van venir pels jueus,
          i jo no vaig dir res, perquè no era jueu.
Després van venir pels comunistes,
          i jo no vaig dir res, perquè no era comunista.
Després van venir pels sindicalistes,
          i jo no vaig dir res, perquè no era sindicalista.
Després van venir per mi,
          i ja no quedava ningú per defensar-me.

No volem tornar als horrors del passat. Hem de dir prou. Prou a l’extensió del feixisme i a la normalització del racisme. I prou als atacs de l’extrema dreta contra Unitat Contra el Feixisme i el Racisme i als seus activistes. No acceptarem un atac contra una persona pel fet de ser del col·lectiu LGBT o nordafricà, ni per ser dona, musulmana, jueva, gitana, sindicalista, d’esquerres, independentista…

Qualsevol pot ser la propera diana. Declarem públicament el nostre suport per a UCFR i la seva gent, que és també la nostra gent. Nosaltres també estem en contra del feixisme i el racisme.”

Directiva Drets Víctimes ben encarada. Ara toca Directiva sobre violència de gènere.

Després de diversos mesos de trílogs, la Comissió de Llibertats Civils, Justícia i Assumptes d’Interior (LIBRE) i la Comissió de Drets de les Dones (FEMM) del Parlament Europeu acabem d’adoptar tot just fa un parell d’hores la proposta de Directiva sobre les normes mínimes relatives als drets, el suport i la protecció de les víctimes de delictes.

Aquesta directiva és un pas molt important per a la consolidació d’un espai de justícia europeu on es garanteixin els drets de les víctimes, així com el seu suport i protecció. Es tracta de drets tan bàsics com la traducció i interpretació, l’accés a serveis mèdics i psicològics i l’accés a la informació pertinent sobre la situació del judici han quedat garantits.

Dos aspectes mereixen ser especialment destacats. Primer, cal tenir en compte les necessitats específiques de les víctimes en els processos penals, independentment de la naturalesa del delicte o del lloc en què s’hagi comès en la Unió Europea. Amb això es pretenen evitar discriminacions per sexe, gènere, religió, raça, lloc d’origen o tipus de residència, entre d’altres. La situació de les persones immigrades en situació irregular han estat una de les nostres màximes preocupacions.

En segon lloc, el text inclou nombroses mencions a la situació de les víctimes de violència de gènere. En aquest sentit s’ha guanyat una important batalla en incloure una protecció específica sobre les dones europees que pateixen encara avui la xacra social del patriarcat. No obstant això el text no és suficient per prevenir i protegir les víctimes de gènere en totes les seves dimensions i és per això que el Parlament i el Consell van acordar demanar una regulació específica sobre violència de gènere. Ara és la Comissió, concretament la Comissària Reding, qui ha de posar sobre la taula una directiva sobre violència contra les dones.

Tras la Directiva de Victimas, la Comisaria Reding debe proponer ahora una Directiva contra la Violencia de Género

Tras varios meses de trílogos, la Comisión de Libertades Civiles, Justicia y Asuntos de Interior y la Comisión de Derechos de las Mujeres adoptaron conjuntamente, hoy, la propuesta de Directiva sobre las normas mínimas relativas a los derechos, el apoyo y la protección de las víctimas de delitos. El Vicepresidente de Verdes/ALE y ponente en la sombra de la Comisión de Derechos de las Mujeres, Raül Romeva y Rueda, dijo después del voto:

“Ésta directiva es un paso muy importante para la consolidación de un espacio de justícia europeo donde se garanticen los derechos de las víctimas, así como su apoyo y protección. Se trata de derechos tan básicos como la traducción e interpretación, el acceso a servicios médicos y psicológicos y el acceso a la información pertinente sobre la situación del juicio han quedado garantizados.

Dos aspectos merecen ser especialmente destacados. Primero, deberá tenerse en cuenta las necesidades específicas de las víctimas en los procesos penales, independientemente de la naturaleza del delito o del lugar en que se haya cometido en la Unión Europea. Con ello se pretende evitar discriminaciones por sexo, género, religión, raza, lugar de origen o tipo de residencia, entre otros. La situación de las personas inmigradas en situación irregular han sido una de nuestras máximas preocupaciones.

En segundo lugar, el texto incluye numerosas menciones a la situación de las víctimas de violencia de género. En este sentido se ha ganado una importante batalla al incluir una protección específica sobre las mujeres europeas que padecen aún hoy la lacra social del patriarcado. Sin embargo el texto no es suficiente para prevenir y proteger a las víctimas de género en todas sus dimensiones y es por eso que el Parlamento y el Consejo acordaron pedir una regulación específica sobre violencia de género. Ahora es la Comisión, concretamente la Comisaria Reding, quién debe poner sobre la mesa una directiva sobre violencia contra las mujeres.”

Sobre decisions, contradecisions i metadecisions econòmiques en clau europea

L’eurogrup es va reunir ahir per discutir el RESCAT espanyol. Aquest és el text del document acordat http://www.consilium.europa.eu/uedocs/cms_data/docs/pressdata/en/ecofin/131648.pdf

Com que cada cop és més dificil no perdre’s en el magma de decisions, contradecisions i metadecisions econòmiques europees, intento seguidament fer una ràpida valoració del contingut de l’acord:

Primer: la decisió fa més aguda encara la sensació de confusió generalitzada

El principal problema és que seguim sense conèixer la lletra petita del memoràndum d’entesa del rescat a Espanya. Ens diuen que s’establirà el 20 de juliol (en un Eurogrup extraordinari).

Sí sabem, però, que el  Fons d’Estabilitat (FEEF) avançarà 30.000 milions d’euros per recapitalitzar la banca. L’avançament respon al fet que no se sap quina és la necessitat total de recapitalització del sistema bancari (es continua esmentant la xifra genèrica de 100.000 milions). A més, el document oficial segueix sense parlar dels tipus d’interès i de les condicions concretes. El fet que els bons a 10 anys no baixin del 7% d’interès és preocupant.

Postergar decisions importants no calma en absolut la legítima inquietud de la ciutadania, que seguexi sense percebre de quina manera aquestes decisions l’afectaran (en positiu o negatiu) en la seva situació personal, i encara menys si aconseguiran acabar amb aquesta terrible imatge que suposa el fet de veure com, mentre els beneficis han anat a les butxaques d’uns quants a qui ningú demana responsabilitats, les conseqüències, i per tant, el cost de la crisi, l’estem pagant entre tots (socialitzant així les pèrdues).

Però és que, a més, sembla que ni tan sols calma els neguits dels anomenats “mercats”. I doncs?

Segon: en diguin com en diguin estem davant d’una intervenció encoberta

Rajoy no ha aconseguit la Unió Bancària i de Guindos no ha pogut trencar la connexió entre el risc sobirà i el risc de la banca privada. Per tant: aquesta socialització de les pèrdues (via garantir el préstec directament o indirectament) significa de fet una intervenció encoberta.

Olli Rehn i el govern espanyol parlen de recapitalització directa dels bancs per via de la FEEF, peró en realitat és una “first-tranche loss” (perdó per l’anglicisme). En altres paraules, vindria a ser un híbrid entre no incrementar el deute directament de l’estat però al mateix temps garantir que, si hi ha pèrdues, sigui aquest qui les assumeixi. Aquest híbrid genera encara més inseguretat jurídica, i també als anomenats mercats.

Per altra banda, els homes de negre, la coneguda troika (la Comissió Europea, el Banc Central Europeu i el Fons Monetari Internacional) aniran a Madrid cada tres mesos. De moment tindran només competències sobre el sector financer. El préstec durarà uns 12-15 anys. Per tant, es confirma la idea que estarem en recessió els propers 20 anys (http://www.ft.com/intl/cms/s/0/c9de2906-c697-11e1-963a-00144feabdc0.html%20#%20axzz20CdrJBOx)

Així mateix, el Banc d’Espanya queda pràcticament sense competència sobirana. És important remarcar que si bé l’FMI no dóna el préstec, aquest estarà involucrat en el “sanejament” del sistema financer. Això, no cal dir-hi, suposa un enorme problema des del punt de vista de la legitimitat democràtica.

Tercer: el compliment del criteri del dèficit s’allarga només un any. Si res no canvia, estem davant de l’enfonsament de l’economia espanyola

Aquest allargament de només un any, a canvi de garantir el deute del FEEF, és un mal negoci per a Espanya i és totalment inassumible. Això ja ho vàrem dir amb l’anterior termini, i s’ha demostrat que no anàvem errats.

Queda clar que Espanya haurà de complir les decisions del Semestre Europeu (avui les establiran), on se seguirà imposant l’agenda neoliberal.

Mentrestant, segueixen els plans d’ajust a Grècia, Portugal i Irlanda, i la troika viatjarà a Xipre per tal d’avaluar la intervenció. A més, la proposta d’Autoritat Europea de Supervisió per poder avaluar si el Mede pot recapitalitzar bancs directament (i que no computi com a deute Estat) no es decidirà fins el setembre.

Fa temps que moltes veus progressistes a la UE demanem la flexibilització de l’agenda, simplement per motius de recessió econòmica. El deute que significa el préstec del FEEF/Mede (fins que entri en vigor l’autoritat de supervisió europea) computarà com a extra. Alguns documents oficials diuen que l’economia espanyola caurà en recessió i en creixement anual negatiu el 2012 i 2013. Si a això se li suma la contracció fiscal, tot plegat suposa la mort econòmica.

I mentrestant, la credibilitat democràtica continua a la UVI.

Lectures viatgeres (IV)

Nou apunt sobre algunes lectures que m’han acompanyat, els darrers mesos, tot al llarg de les nombroses hores de trànsit, vol, trajecte ferroviari o hores d’espera a diversos racons de la turbulenta Europa.

 

Poesia

 

Començo per un dels gèneres que més m’agrada, la poesia, i per un dels autors que ha revolucionat el vers fins a nivells inimaginables, Josep Pedrals. Vaig adquirir el seu ‘Romanço d’Anna Tirant’ (labreu edicions, Alabatre) després d’escoltar l’autor parlar-ne per la ràdio. El vaig començar a llegir amb moltes expectatives. I en acabar-lo, aquestes no només es van veure satisfetes sinó incrementades. És una meravella. No ho sé expressar d’una altra manera. És un text virtuós, irònic, curós, innovador, tendre, inspirador. I el més significatiu, per a mi, és que confesso que no sé si vaig acabar d’entendre del tot els diàlegs Pedrals/Quim Porta (alter ego de Pedrals), però, com diu el mateix autor, ‘què importa’?. Precisament trobo que aquesta és una de les singularitats del text: que no acabes de tenir clar si allò que has entès, és el que el poeta (un dels pocs professionals del gènere, com diu a la contraportada) pretenia que entenguéssis. Però, tal i com faig sovint amb la poesia, no deso el llibre, l’aparco, per reprendre’l d’aquí a un temps, i llegir-lo de nou. Tinc curiositat per saber si l’entendré igual, o no. Veurem.

 

Assaig

 

Ara llibres ens proporciona un dels treballs més impactant que he llegit en molt de temps. Són les reflexions d’un gran professional, en Nico Valle, corresponsal per a TV3 a nombrosos conflictes (bèl·lics, pre-bèl·lics i post-bèl·lics) d’arreu del planeta. Amb ‘Un viatge al cor de la guerra’, en Nico repassa les virtuts, misèries i contradiccions d’una feina que no vé amb cap manual d’instruccions. La seva és una tasca que depèn, sobretot, d’una gran dosi de sentit comú, amarat amb un punt de sensibilitat personal i capacitat d’empatia, i regat per un alt nivell d’autocontrol emocional. I res d’això, que jo sàpiga, no s’ensenya a cap facultat. És per això que ajuda molt, penso, als qui s’hi dediquen, comptar amb les reflexions de la gent que hi ha passat abans. Al llarg de la meva vida he tingut ocasió de llegir molts treballs d’aquestes característiques, per raons professionals i personals. I el d’en Nico el situo, sens dubte, en la part més alta del meu particular rànquing de material imprescindible. Un plaer llegir el text, un honor conèixer el personatge, una obligació parlar-ne.

 

Ficció

 

En l’apartat de ficció esmento en aquest ‘Lectures viatgeres’, quatre títols. Dos d’ells tenen com a tema la Guerra Civil (guerra i postguerra). És un tema molt tractat, sí. Trillat, fins i tot, diuen algunes veus. I tanmateix continua essent imprescindible mantenir viva la memòria. Amb perspectiva històrica no estem tan lluny d’aquell fets. I és bo recordar que l’oblit és el camí més curt cap a la repetició dels mateixos. Tanmateix, és també cert que convé trobar maneres de parlar-ne que siguin diferents, noves, originals i contemporànies. I això és el que fan, precisament, en Sebastià Alzamora amb ‘Crims de sang’ (Premi Sant Jordi 2011, Òmnium/Proa) , i Almudena Grandes amb ‘El lector de Julio Verne’ (Tusquets). En Sebastià, amb qui vaig poder compartir algunes taules durant la signatura de Sant Jordi (constatant així el gran èxit que ha suposat la seva novel·la) embolica la història d’uns fets (inici de la guerra, 1936) amb una capa de sang gòtica i vampírica del tot original. Llegit en clau novel·la de ficció, compta amb tots els ingredients per tal de mantenir el lector atrapat fins a la darrera pàgina. Però és que es tracta d’això, no? Per la seva banda, l’Almudena relata amb la virtuositat literària a la que ens té acostumats, una història que li va explicar un amic seu durant un viatge, la de Nino Pérez, un fill de Guàrdia Civil que vivia en una caserna durant la postguerra. Personalment, en tant que gran enamorat de les novel·les vernianes, confesso que em vaig quedar amb ganes de trobar-hi més paral·lelismes, però això no treu mèrits, en absolut, al resultat global.

El tercer títol que vull esmentar és ‘Hipnofòbia’, de Salvador Macip (Premi Carlemany per al foment de la lectura, Proa). En Salvador és una d’aquestes persones obsessionades amb què allò que fa (recerca científica), no només sigui útil, sinó també accessible. I això, avui dia, té molt de mèrit. A Hipnofòbia ens proposa un repte: preguntar-nos per què dormim?. Però és que la resposta que ens ofereix obre, per la seva banda, nous interrogants. En Salvador basteix un dilema filosòfic amb una trama entre la fantasia, el relat científic i la intriga. I als qui ens agraden els tres registres, lògicament, li estem molt agraïts.

Finalment, en un altre registre ben diferent als anteriors, cal esmentar el treball d’un escriptor consolidat com és en Jordi Coca. A ‘En caure la tarda’ (Edicions 62, El Balancí), en Jordi construeix un relat introspectiu a partir de la transformació psicològica d’un home, en Miquel Gironès, que es mostra desconcertat davant d’un món que canvia. Però és el món que l’envolta, allò que canvia? O potser és ell que canvia? La seva és una prosa àgil, directa, accessible, i a la vegada rica i complexa. I el recorregut del protagonista ens permet viure en primera persona el que podria ser l’evolució personal de qualsevol de nosaltres, si les circumstàncies fossin unes altres. O potser no. I és que cada cas és diferent. Aquesta és, precisament, la gràcia del relat (o una d’elles).

La Internet Society se estrena en Madrid con un debate sobre derechos de creación

Europa entierra ACTA

La compatibilidad entre los derechos de propiedad intelectual e Internet fue el tema para una discusión abierta entre Víctor Domingo, presidente de la Asociación de Internautas, Alejandro Perales, presidente de la Asociación de Usuarios de la Comunicación (AUC) y el cineasta Stéphane Grueso. El debate, organizado por el capítulo español de la Internet Society, una organización internacional, cuya misión, según sus propias palabras, es ?que Internet sea para todos?. El coloquio fue moderado por el periodista Miguel Ángel Uriondo, y sirvió para cerrar la primera conferencia de la organización en Madrid.

El rechazo por parte del Parlamento Europeo del Acuerdo Internacional contra la falsificación y la piratería (ACTA) ha dado nuevos argumentos a los defensores de una Internet libre pero también ha prorrogado una discusión que, para Domingo, es ya ?una pérdida de tiempo? que abruma al resto de debates sobre el futuro de la Red.

Según Domingo, el Estado ?no puede poner los derechos corporativos por encima de los derechos de los ciudadanos?. Internet desbarata los conceptos de propiedad intelectual y ?prostituye? el debate. ?Hay que volver a definir la propiedad intelectual en función de los nuevos soportes?, indica. Para Stéphane Grueso, vivimos un proceso de reconversión industrial: el modelo basado en la venta de copias ha dejado de tener sentido, pero la industria no quiere aceptar ese cambio de paradigma. ?Y cuanto antes lo acepten, mejor les va a ir?. Alejandro Perales diferenció entre la piratería, es decir, el negocio de permitir el acceso a contenidos sobre los que no se han satisfecho derechos de autor, y el intercambio de contenidos en un entorno ?no lucrativo?, que, según el presidente de la AUC, ?no tiene nada que ver con la piratería?.

Los tres participantes en el debate coincidieron en que las soluciones que los gobiernos están intentando aplicar, en especial la llamada ley Sinde-Wert, van más allá de la simple vigilancia del respeto a los derechos de autor. ?Tratan de controlar la información que se intercambian los ciudadanos?, opinó Grueso. ?Los derechos digitales son los derechos civiles del siglo XXI?, consideró Domingo, ?y lo que se nos intenta quitar es el milagro de una comunicación libre?. El presidente de la Asociación de Internautas hizo énfasis en que la libertad de acceso a Internet en España se ve coartada por el alto precio de la banda ancha, ?una de las más caras de Europa? y se preguntó ?como dos ministros de Cultura tan ideológicamente contrapuestos son abducidos hacia a las mismas conclusiones cuando se trata de propiedad intelectual?.

Los productos digitales tienen un mercado siempre y cuando los precios empiecen a bajar

Ante la pregunta de como enfrentarse a la apropiación indebida de contenido, los tres participantes en el debate hicieron hincapié en la escasez de la oferta legal. Para Perales, el déficit de oferta es ?palmario? y fomenta las descargas extraoficiales. Domingo puso como ejemplo las series de televisión: mientras las distribuidoras tienen un catálogo de entre 300 y 400 programas, en las redes P2P hay disponibles más de 1.700, señal de una industria que, según él, ?no se ocupa de la oferta?. Grueso indicó que él gasta ?cientos de euros? en productos culturales pero ?ninguno de ellos? en España, debido a la escasez de los catálogos y el alto precio de los productos en comparación con otros países. Según ellos, el éxito en España de servicios como Spotify, que ofrece música por cantidades ?razonables?, confirman que hay un mercado disponible siempre y cuando los precios bajen.

Ante la duda sobre si hay vías para una solución intermedia entre usuarios, creadores y gobiernos para llegar a un consenso, Domingo consideró que un diálogo constructivo ?es posible?, pero que ?todos debemos dejarnos pelos en la gatera?. Grueso prefirió considerarlo una disputa entre los ciudadanos y el poder, una pugna entre buenos y malos en la que ?vamos a ganar los buenos?. Según el director de la oficina regional de la Internet Society en Europa, Frédéric Donck, al menos a nivel internacional, los canales para el debate están abiertos ?permanentemente?.

La Internet Society, fundada en 1992, tiene más de 55.000 socios en 72 países, y está presente en España desde 1995. Entre sus objetivos fundamentales está el desarrollo de estándares abiertos, el fomento de discusiones a escala global sobre el futuro de Internet y la difusión de información sobre la Red.

Aquesta sessió tocava fer-ne una sobre la política de la UE en relació al West Bank i a Jerusalem Est. European Parliament resolution on EU policy on the West Bank and East Jerusalem

The European Parliament,

(…)

A.         whereas the EU has repeatedly confirmed its support for the two-state solution with the State of Israel with secure and recognised borders and an independent, democratic, contiguous and viable State of Palestine living side by side in peace and security, and declared that no changes to the pre-1967 borders, other than those agreed by the parties, will be recognised, including with regard to Jerusalem as the capital of two states; whereas the right of Palestinians to self-determination and to have their own state is unquestionable, as is the right of Israel to exist within safe borders;

B.         whereas the Council conclusions of 14 May 2012 underlined that ‘the ongoing changes across the Arab world make the need for progress on the Middle East peace process all the more urgent’ and that ‘heeding the aspirations of the people in the region, including those of Palestinians for statehood and those of Israelis for security, is a crucial element for lasting peace, stability and prosperity in the region’;

C.         whereas direct peace talks between the parties are stalled and all recent efforts to resume negotiations have failed; whereas the EU has called on the parties to pursue actions conducive to an environment of confidence necessary to ensure meaningful negotiations, to refrain from actions that undermine the credibility of the process and to prevent incitement;

D.         whereas (…)

(…) Israel and the Palestinian Authority issued the following joint statement on 12 May 2012: ‘Israel and the Palestinian Authority are committed to achieving peace and the sides hope that the exchange of letters between President Abbas and Prime Minister Netanyahu will further this goal’;

E.         whereas international human rights and humanitarian law, including the Fourth Geneva Convention, is fully applicable to the West Bank, including East Jerusalem and the Gaza Strip; whereas Israel is obliged, inter alia, to ensure in good faith that the basic needs of the occupied Palestinian population are met, administer its occupation in a manner that benefits the local population, protect and preserve civilian objects, and avoid the transfer of its own population into the occupied territory and of the population of the occupied territory into its own territory;

F.         whereas the recent EU Heads of Mission reports on ‘Area C and Palestinian State Building’, on East Jerusalem, and on settler violence, confirmed once more alarming and potentially irreversible developments on the ground in the areas concerned; whereas the Israeli Ministry of Foreign Affairs rejects the claims made in the EU papers and has criticised the papers stating that they do not help to advance the peace process;

G.         whereas, since the 1995 Oslo Agreements, the West Bank has been administratively divided into three zones or areas; whereas Area C composes the largest portion of the West Bank territory; whereas social and economic developments in Area C are of critical importance for the viability of a future Palestinian state;

H.         whereas the Palestinian presence in the West Bank, with special regard to Area C, and in East Jerusalem has been undermined by Israeli Government policies, especially by the building and expansion of settlements; whereas Israeli settlements are illegal under international law and constitute a major obstacle to peace efforts while they are subsidised by the Israeli Government with considerable incentives in the fields of taxation, housing, infrastructure, roads, access to water, education, health care etc.;

I.          whereas Israel, in its ‘Basic Law: Jerusalem, Capital of Israel’ of 1980, declared Jerusalem the complete and united capital of Israel, which is in contradiction with UN Security Council resolution 478 (1980); whereas the Council conclusions of 14 May 2012 reiterated again that a way must be found through negotiations to resolve the status of Jerusalem as the future capital of two states; whereas current developments in East Jerusalem, make the prospect of Jerusalem becoming the future capital of two states increasingly unlikely and unworkable in  practice; whereas East Jerusalem is increasingly detached from the West Bank while the Historic Basin within Jerusalem is increasingly detached from the rest of East Jerusalem;

J.          whereas, while Palestinians living in East Jerusalem represent 37 % of the population of Jerusalem and account for 36 % of the municipality’s fiscal revenues, only 10 % of the municipal budget is spent in East Jerusalem, with the provision of services being highly inadequate; whereas most Palestinian institutions, including the Orient House, have been closed by the Israeli authorities in East Jerusalem, creating an institutional and leadership vacuum in the local Palestinian population, which remains a key concern;

K.         whereas Palestinians living in East Jerusalem have a permanent-resident status which can only be transferred to children under certain conditions and is not automatically transferred through marriage, preventing spouses and children of many East Jerusalem permanent residents from living with their family members; whereas, on the other hand, approximately 200 000 Israeli settlers are living in and around East Jerusalem;

L.         whereas protecting the Palestinian population and its rights in the West Bank, with special regard to Area C, and in East Jerusalem is of the utmost importance for preserving the viability of the two-state solution; whereas the ongoing expansion of settlements and settler violence, planning restrictions and the consequent acute house shortage, house demolitions, evictions and displacements, confiscation of land, difficult access to natural resources, and the lack of basic social services and assistance are having a significant negative impact on the living conditions of Palestinians; whereas the economic situation in these areas, aggravated by the restrictions on access, movement and planning, remains a major source of concern; whereas, according to the annual ILO report, 53.5 % of young women and 32.3 % of young men between the ages of 15 and 24 in the West Bank are unemployed;

M.         whereas the Palestinian population in the West Bank, in Area C in particular, and in East Jerusalem faces serious water shortages; whereas Palestinian farmers are seriously affected by the lack of water for irrigation, which stems from the use of most of the water in question by Israel and by Israeli settlers; whereas the availability of sufficient water resources is essential to the viability of a future Palestinian State;

N.         whereas the separation wall built by Israel, which does not follow the Green Line, cuts off considerable parts of Palestinian territory both in the West Bank and in East Jerusalem; whereas the advisory opinion of the International Court of Justice entitled ‘Legal Consequences of the Construction of a Wall in the Occupied Palestinian Territory’ of 2004 declared that ‘the construction of the wall being built by Israel (…), and its associated régime, are contrary to international law’;

O.         whereas Parliament has repeatedly expressed its support for the state-building efforts of President Mahmoud Abbas and Prime Minister Salam Fayyad and acknowledged and welcomed the success of the two-year state-building plan of Prime Minister Fayyad; whereas Area C and East Jerusalem should remain priorities in Palestinian national development plans, particularly in response to the sense of neglect felt by Palestinians living in these areas;

P.         whereas more than 4500 Palestinian prisoners, including 24 members of the Palestinian Legislative Council, around 240 children, and more than 300 Palestinian administrative detainees, are currently detained in Israeli prisons and detention centres;

Q.         whereas Arab Bedouins are indigenous people leading a sedentary and traditionally agricultural life on their ancestral lands and are seeking formal and permanent recognition of their unique situation and status; whereas Arab Bedouin communities, threatened by Israeli policies undermining their livelihoods and including forced transfer, are a particularly vulnerable population both in the occupied Palestinian Territory and in the Negev;

R          whereas, according to the report of the Displacement Working Group (DWG) which was published on 14 May 2012 and to the monthly Humanitarian Monitor of OCHA, more than 60 structures, including solar panels, water tanks and agricultural buildings, funded by the European Union and a number of its Member States, were destroyed by Israeli forces since January 2011; whereas more than 100 similar projects are under threat of demolition;

S.         whereas, on many occasions, including in the Council conclusions of 14 May 2012, the EU and its Member States have reiterated their fundamental commitment to the security of Israel, condemned in the strongest terms violence deliberately targeting civilians, including rocket attacks from the Gaza Strip, and called for the effective prevention of arms smuggling into Gaza;

T.         whereas Article 2 of the EU-Israel Association Agreement states that relations between the parties shall be based on respect for human rights and democratic principles, which guides their internal and international policy and constitutes an essential element of this agreement;

U.         whereas the blockade of and the humanitarian crisis in the Gaza Strip has continued since 2007 despite numerous calls made by the international community for the immediate, sustained and unconditional opening of crossings for the flow of humanitarian aid, commercial goods and persons to and from Gaza, as also reiterated in the Council conclusions of 14 May 2012;

1.         Reiterates its strong support for the two-state solution on the basis of the 1967 borders, with Jerusalem as capital of both states, and with the State of Israel with secure and recognised borders and an independent, democratic, contiguous and viable State of Palestine living side by side in peace and security;

2.         Welcomes the Council conclusions on the Middle East Peace Process of 14 May 2012 – which include conclusions on the West Bank and East Jerusalem – and reiterates that the EU will not recognise any changes to the pre-1967 borders, including with regard to Jerusalem, other than those agreed by the parties, also welcomes the Middle East Quartet statement of 11 April 2012;

3.         Stresses that ending the conflict is a fundamental interest of the EU, as well as of the parties themselves and the wider region, and that this can be achieved through a comprehensive peace agreement, based on the relevant UN Security Council resolutions, the Madrid Principles including land for peace, the Roadmap, the agreements previously reached by the parties and the Arab Peace Initiative; insists on the fact that any resulting resolution should not affect the dignity of either side; notes that the EU, as the largest donor to the Palestinian Authority and one of Israel’s major trading partners has instruments at its disposal to more actively encourage both parties to work towards a solution; calls on both parties to work together with the EU, which should pursue all efforts to resolve the conflict; recalls the applicability of international humanitarian law in the occupied Palestinian territory, including the applicability of the Fourth Geneva Convention relative to the Protection of Civilian Prsons in Time of War;

4.         Stresses that direct negotiations leading to a two-state solution between Israelis and Palestinians should be resumed without delay and according to the deadlines called for by the Quartet, in order to overcome the unacceptable status quo; welcomes the exchange of letters between the parties initiated on 17 April 2012 and the joint statement by Israel and the PA of 12 May 2012;

5.         Expresses its deepest concern about developments on the ground in Area C in the West Bank and in East Jerusalem, as described in the EU Heads of Mission reports on ‘Area C and Palestinian State Building’ of July 2011 and on East Jerusalem of January 2012,

6.         Stresses the importance of protecting the Palestinian population and its rights in Area C and in East Jerusalem, which is essential for keeping the viability of the two-state solution alive;

7.         Reiterates that all settlements remain illegal under international law and calls on the Israeli Government to stop all construction and extension of settlements in the West Bank and East Jerusalem and to dismantle all outposts erected since March 2001;

8.         Strongly condemns all acts extremism, violence and harassment committed by settlers against Palestinian civilians and calls on the Israeli Government and authorities to bring the perpetrators of such acts to justice and hold them accountable;

9.         Calls for full and effective implementation of existing EU legislation and EU-Israel bilateral agreements to ensure that the EU control mechanism – the ‘technical arrangements’ – does not allow Israeli settlement products to be imported to the European market under the preferential terms of the EU-Israel Association Agreement;

10.       Calls on the Israeli Government and authorities to meet their obligations under international humanitarian law, in particular by

            –          securing an immediate end to house demolitions, evictions and forced displacement of Palestinians,

            –          facilitating Palestinian planning and building activities and the implementation of Palestinian developments projects,

            –          facilitating access and movement,

            –          facilitating the access of Palestinians to farming and grazing locations,

            –          ensuring a fair distribution of water meeting the needs of the Palestinian population,

            –          improving access of the Palestinian population to adequate social services and assistance, in particular in the fields of education and public health, and

            –          facilitating humanitarian operations

            in Area C and in East Jerusalem;

12.       Calls for an end to the administrative detention without formal charge or trial of Palestinians by Israeli authorities, for access to a fair trial for all Palestinian detainees, and for the release of Palestinian political prisoners, with special regard for members of the Palestinian Legislative Council, including Marwan Barghouti, and administrative detainees; calls also for the immediate release of Nabil Al-Raee, the artistic director of the Freedom Theatre in Jenin Refugee Camp, arrested on and detained since 6 June 2012; welcomes the agreement reached on 14 May 2012 that allowed for the end of the hunger strike of the Palestinian prisoners and calls for its full and immediate implementation;

13.       Calls for the protection of the Bedouin communities of the West Bank and in the Negev, and for their rights to be fully respected by the Israeli authorities, and condemns any violations (e.g. house demolitions, forced displacements, public service limitations); calls also, in this context, for the withdrawal of the Prawer Plan by the Israeli Government;

14.       Encourages the Palestinian Government and authorities to pay increasing attention to Area C and East Jerusalem in Palestinian national development plans and projects, with the aim of improving the situation and living conditions of the Palestinian population in these areas;

15.       Stresses again that peaceful and non-violent means are the only way to achieve a sustainable solution to the Israeli-Palestinian conflict; continues to support, in this context, President Abbas’ policy of non-violent resistance and to encourage intra-Palestinian reconciliation and Palestinian state-building, and considers presidential and parliamentary elections to be important elements of this process;

16.       Reiterates its strong commitment to the security of the State of Israel; condemns any act of violence by any party deliberately attacking civilians, and is appalled by the rocket attacks from the Gaza Strip;

17.       Calls on the Council and the Commission to continue to support and deliver assistance to Palestinian institutions and development projects in Area C and in East Jerusalem with the aim of protecting and strengthening the Palestinian population; calls for improved coordination between the EU and Member States in this field; stresses that Israel must put an end to the practice of withholding customs and tax revenues belonging to the Palestinian Authority;

18.       Calls on the EEAS and the Commission to verify on the ground all allegations concerning the destruction of and damage caused to EU-funded structures and projects in the occupied territory, and submit the results to Parliament;

19.       Calls on the Council and the Commission to continue to address these issues at all levels in the EU’s bilateral relations with Israel and the Palestinian Authority; stresses that Israel’s commitment to respect its obligations under international human rights and humanitarian law towards the Palestinian population must be taken into full consideration in the EU’s bilateral relations with the country;

20.       Urges the EU and Member States again to play a more active political role, including within the Quartet, in the efforts aimed at achieving a just and lasting peace between Israelis and Palestinians; stresses again the central role of the Quartet and continues to support the High Representative in her efforts to create a credible perspective for re-launching the peace process;

21.       Reiterates its call for the immediate, sustained and unconditional lifting of the blockade of the Gaza Strip in terms of persons, the flow of humanitarian aid and commercial goods, and for steps allowing for the reconstruction and economic recovery of this area; calls also, with due recognition of Israel’s legitimate security needs, for an effective control mechanism preventing the smuggling of arms into Gaza; takes note of the decision of the Council to extend the mandate of the European Border Assistance Mission Rafah until 30 June 2013 and expects it to fulfil its tasks and play a decisive and effective role as regards the daily management of cross-border relations and the build-up of confidence between Israel and the Palestinian Authority;

22.       Instructs its President to forward this resolution to the Council, the Commission, the Vice-President of the Commission/High Representative of the Union for Foreign Affairs and Security Policy, the governments and parliaments of the Member States, the EU Special Representative to the Middle East Peace Process, the President of the UN General Assembly, the governments and parliaments of the UN Security Council members, the Middle East Quartet Envoy, the Knesset and the Government of Israel, the President of the Palestinian Authority and the Palestinian Legislative Council.

Violence against LGBTI women in Africa (Debate and Resolution in the European Parliament)

Yes. All human beings are born free and equal in dignity and rights. And all states have the obligation to prevent violence and incitement to hatred based on sexual orientation, gender identity and gender expression, and to respect the principles of equality between women and men;

However, the stigmatisation of and violence against lesbian, bisexual, transgender and intersex women, as well as against women perceived as, by state and police forces, by the women’s families, and by community members, is far from disappearing in many countries.

Today we concentrate in the situation of women in Africa, where female homosexuality is legal in 27 countries and illegal in other 27.

Thus, I am glad this Parliament strongly condemns (see resolution below) all forms of violence and discrimination against lesbians in African countries where this is taking place, including extreme forms of violence, such as ‘corrective’ rapes, and other forms of sexual violence;

And that expresses its strong support for campaigns and initiatives aimed at abolishing all discriminatory laws against women and LGBTI persons.

JOINT MOTION FOR A RESOLUTION
pursuant to Rules 122(5) and 110(4), of the Rules of Procedurereplacing the motions

by the following groups: ECR (B7?0389/2012); Verts/ALE (B7?0392/2012); ALDE (B7?0397/2012); S&D (B7?0400/2012); GUE/NGL (B7?0401/2012)

on violence against lesbian women and the rights of lesbian, gay, bisexual, transgender and intersex (LGBTI) persons in Africa (2012/2701(RSP))
A.   whereas all human beings are born free and equal in dignity and rights; whereas all states have the obligation to prevent violence and incitement to hatred based on sexual orientation, gender identity and gender expression, and to respect the principles of equality between women and men;

B.   whereas the rights of lesbian, bisexual, transgender and intersex women are the same human rights as those of all women and all men, which must be protected regardless of their sexual orientation, gender identity or gender expression;

C.   whereas some African countries (…)

have been at the forefront of action to uphold human rights and fundamental freedoms, whereas South Africa’s post-apartheid constitution was the first in the world to outlaw discrimination based on sexual orientation and whereas South Africa was the initiator of UN Human Rights Council resolution 17/19 on human rights, sexual orientation and gender identity;

D.   whereas there are political movements and leaders that will be able to lead the way to changes and to the strengthening of human rights, women’s rights and the rights of lesbian, gay, bisexual, transgender and intersex (LGBTI) persons in Africa;

E.   whereas there is increasing stigmatisation of and violence against lesbian, bisexual, transgender and intersex women, as well as against women perceived as lesbian, bisexual, transgender or intersex, by state and police forces, by the women’s families, and by community members in Africa, which is a shared concern, as exemplified by the numerous statements by UN Secretary-General Ban Ki Moon and UN High Commissioner for Human Rights Navanethem Pillay and by UNHRC Resolution 17/19 of 17 June 2011 on human rights, sexual orientation and gender identity;

F.   whereas, in the UN Human Rights Council’s annual discussion on women human rights defenders on 25-26 June 2012, UN Special Rapporteur on Human Rights Defenders Margret Sekaggya pointed out that violations suffered by women human rights defenders took a gender-specific form, ranging from verbal abuse based on sex, to sexual abuse and rape, that women were deemed to be challenging accepted social norms, culture or traditions or challenging religious prescriptions, and were as a consequence stigmatised, and that women human rights defenders needed specific attention because the suffering they underwent in their work sometimes exceeded that of their male counterparts;

G.   whereas women who transgress social and cultural norms are liable to be labelled lesbian and risk becoming a target for male violent behaviour and/or degrading treatment, and whereas this has the effect of repressing the expression of all women’s sexuality and freedom of choice, including that of heterosexual women; whereas sexual rights are related to the bodily autonomy and freedom of choice of all women;

H.   whereas, in Africa, female homosexuality is legal in 27 countries and illegal in 27, whereas male homosexuality is legal in 16 countries and illegal in 38, whereas homosexuality is punishable by death in Mauritania, Sudan, parts of Somalia and Nigeria, and whereas a private member’s bill before the Ugandan parliament provides for the death penalty for homosexuality;

I.    whereas laws that criminalise same-sex relationships and sexuality contribute to creating a climate which encourages violence against women who are, or are perceived to be, lesbians;

J.    whereas killings, torture, imprisonment, violence, stigmatisation and hate speech targeting LGBTI people, sometimes legitimised by law, are reported in all regions of the world; whereas there have been repeated acts of violence and aggression against lesbians in several African countries;

K.   whereas the struggle for equality and justice and for the visibility and rights of lesbians is closely connected with the overall struggle for women’s human rights; whereas lesbians are also, like many other women, subjected to violence, both for being women and on account of their sexual orientation;

L.   whereas in Cameroon, ten women were arrested, and three charged for the first time, for practising homosexuality in February 2012; whereas arrests and beatings by the police are ongoing, with the latest recorded instance on 24 June 2012; whereas lawyer Alice Nkom has on numerous occasions been threatened with death and violence for defending people accused of homosexuality; whereas an LGBTI meeting in Yaoundé was violently broken up by a gang on 19 May 2012;

M.   whereas the Liberian Senate is currently debating a proposal to extend further the ban on same-sex relationships foreseen by current law; whereas the media and general public are increasingly seeking to intimidate LGBTI people; whereas two lesbian women in Liberia were recently attacked by armed men;

N.   whereas in Malawi, female homosexuality was newly outlawed in January 2011; whereas the new President Joyce Banda has stated that she will ask the parliament to repeal laws criminalising homosexuality;

O.   whereas in Nigeria, the ‘Same-Sex Marriage Prohibition Bill’ seeks to criminalise  the registration, operation and sustenance of certain organisations and their meetings or processions, and outlaws activities that fall strictly within the bounds of private life; whereas discussions of this Bill have contributed to increased tensions and threats against LGBTI people;

P.   whereas in South Africa, so-called ‘corrective’ rapes of lesbian and transgender women continue unabated; whereas ongoing debates about the constitutional protection of persons victimised because of their sexual orientation are fuelling violence against LGBTI people; whereas gay activist Thapelo Makutle was recently tortured and killed, 22-year-old lesbian Phumeza Nkolonzi was shot in the head because of her sexual orientation, and Neil Daniels was stabbed, mutilated, and burnt alive because he was gay;

Q.   whereas in Swaziland, positive efforts are being made to prevent and cure HIV/AIDS in populations at risk, including women, and men who have sex with men, the country’s criminalisation of homosexuality notwithstanding;

R.   whereas in Uganda, in February and June 2012, police forces and the Minister for Ethics and Integrity, acting without warrants and in disregard of citizens’ freedom of assembly, stopped private meetings of human rights activists; whereas the Minister plans to outlaw 38 organisations understood to work for the human rights of LGBTI people; whereas the Anti-Homosexuality Bill first proposed in 2009 is still under discussion, and may include unacceptable provisions including the death penalty; whereas lawsuits and enquiries in Uganda and in the United States have revealed the role of, among others, Scott Lively and the Abiding Truth Ministries, a fundamentalist US-based evangelical group, in spreading hate and intolerance on the basis of sexual orientation, and in having the law introduced;

Discrimination and violence against lesbian women in Africa

1.   Strongly condemns all forms of violence and discrimination against lesbians in African countries where this is taking place, including extreme forms of violence, such as ‘corrective’ rapes, and other forms of sexual violence;

2.   Expresses its strong support for campaigns and initiatives aimed at abolishing all discriminatory laws against women and LGBTI persons; calls on those African countries that still have discriminatory laws in place to abolish these immediately, including laws that prohibit homosexuality and laws that discriminate against women in terms of civil status, property and inheritance rights;

3.   Confirms that the struggle for the fundamental and human rights of lesbians in Africa is closely linked to the protection of the sexual and reproductive rights and health of all women; calls, therefore, on the European Union, in its work with partner countries in Africa, to make a firm commitment in terms of resources and policy in support of sexual and reproductive health and rights;

4.   Calls on the relevant authorities in Africa to effectively protect all women from murder, so?called ‘corrective’ rape and other sexual violence, and to bring the perpetrators to justice;

5.   Notes that the stigmatisation of ,and the violence directed against, lesbian, bisexual, transgender and intersex women are often closely connected with discrimination;

6.   Expresses its solidarity with, and support for, all actors that mobilise for a stronger women’s rights agenda;

7.   Calls on the European Commission and the Member States to support women’s organisations and LGBTI organisations in Africa in their struggle for the equality, bodily autonomy and right to freedom in sexuality of all women and LGBTI persons; highlights, at the same time, the need to give special attention to lesbians within the LGBTI and the women’s movement, as well as in other social movements, in order to denounce the double or sometimes multiple discrimination faced by lesbians in African countries;

8.   Calls on the European Commission, the European External Action Service and the Member States to step up the implementation of the goals set out in the EU Plan of Action for Gender Equality and Women’s Empowerment in Development, and to pay particular attention to the rights of lesbian, bisexual, transgender and intersex women, both in their relations with third countries and when lending support to non-governmental organisations and human rights defenders;

LGBTI rights in Africa

9.   Calls on all 76 countries worldwide where homosexuality is illegal, including 38 countries in Africa, to decriminalise homosexuality;

10. Denounces incitement to hatred and violence on grounds of sexual orientation, gender identity or gender expression; calls on the aforementioned countries to effectively uphold LGBTI people’s right to life and dignity, and condemn all acts of violence, discrimination, stigmatisation and humiliation directed against them;

11. Calls on political and religious leaders to condemn persecution and discrimination based on sexual orientation and to take a firm stance against homophobia, hereby joining Archbishop Desmond Tutu’s call against injustice and prejudice and for solidarity and justice;

12. Calls on the EEAS, the European Commission and the Member States, in their political dialogue with African countries, to remind them of their obligation to fulfil the commitments assumed under legally binding international human rights instruments and conventions, and in particular to respect and promote the right to non-discrimination based on sexual orientation and gender identity;

13. Welcomes the fact that some African countries, including Cape Verde, the Central African Republic, Gabon, Guinea-Bissau, Malawi, Mauritius, Rwanda, São Tomé and Principe, South Africa and Swaziland have made known their opposition to the criminalisation of homosexuality, have ensured access to healthcare for LGBTI people or have pledged to decriminalise homosexuality;

14. Calls on the ACP Group of States to engage in an open, constructive and mutually respectful discussion;

15. Calls on the African countries to ensure security for LGBTI human rights defenders, and calls on the EU to assist local civil society with capacity-building programmes in Africa;

16. Insists that trade agreements and development programmes include non-negotiable human rights and non-discrimination clauses, particularly under the Development Cooperation Instrument and the Cotonou Agreement, and that they must be in conformity with the new human rights-based approach to EU development policies, not least as regards action to combat  discrimination based on gender and sexual orientation;

17. Urges the European Commission, the EEAS and the Member States to make full use of the LGBT Toolkit to encourage third countries to decriminalise homosexuality, help reduce violence and discrimination and protect LGBTI human rights defenders;

18. Calls on the European Commission to continue funding non-governmental organisations working to protect the rights of LGBTI people, notably through the EIDHR;

19. Recalls the Member States’ obligation, under Directive 2004/83/EC (recast), to protect or grant asylum to third-country nationals escaping or risking persecution in their country of origin on the basis of their sexual orientation and gender identity;

20. Calls on the Commission, and notably on Catherine Ashton, High Representative of the Union for Foreign Affairs and Security Policy and Vice-President of the European Commission, to take concrete action, by mobilising all appropriate instruments, to exert pressure in order to protect people from discrimination and persecution on the basis of their sexual orientation, and to raise these issues in the course of the EU’s relations and dialogues with third countries; calls on the Commission to include these issues in the roadmap against homophobia which the European Parliament has on several occasions called on it to draft[1];

21. Instructs its President to forward this resolution to the Council, the Commission, the High Representative / Vice-President for Foreign Affairs and Security Policy, the Member States, the Secretary-General of the ACP Group of States, all Ambassadors of ACP states to the European Union, the South African Parliament, and the African Union and its institutions.
