Carta a l’ONU (8 de Maig – Ginebra)

Excel·lentíssim
Senyor,

     Assabentats que els dies 5-7 de maig de
2010 el Consell de drets Humans de l’ONU que la seva Excel·lència presideix
serà informat, seguint les normes de l’EPU, sobre la situació dels drets humans
al Regne d’Espanya, els sotasignats es permeten sol·licitar-li que tingui en
consideració el següent:

      El proper dia 8 de maig, davant del Palau
de les Nacions Unides de Ginebra, es farà una concentració pacífica de
ciutadans catalans, vinguts de les terres catalanes i d’altres indrets
d’Europa, per a donar testimoni de la voluntat expressada, per cada dia més
compatriotes, en el sentit que el poble català pugui exercir el dret a
l’autodeterminació; dret que pertany a tots els pobles del món, com bé ha
reconegut repetidament la mateixa ONU. Aquesta voluntat ha quedat ben palesa ja
en múltiples ocasions anteriors, en diversos i successius documents escrits per
personalitats representatives del nostre país i adreçats a les Nacions Unides,
des del mateix any de la seva creació. També ha quedat palesa aquesta voluntat
en decisions assumides per la Cambra de representació legal democràtica del
poble català, és a dir pel Parlament Autònom de Catalunya. I finalment la
mateixa voluntat s’explicità en una concentració popular davant la mateixa seu
de l’ONU el 1985 i en altres iniciatives sorgides igualment de la societat
civil. Entre aquestes despunten les que s’estan duent a terme ara, d’una manera
exemplar, com han constatat desenes d’observadors internacionals, que han pres
la forma de consultes o referèndums que han donat com a resultat l’opció, ja
votada lliurement i explícitament per gairebé cinc-centes mil persones, per la
independència de la nació catalana.

       El posem al corrent d’aquests fets perquè, al nostre entendre,
s’emmarquen en la missió del Consell de drets humans de les Nacions Unides que
consisteix, entre altres coses, en vetllar per tal que tots els Estats membres
de l’ONU promoguin i facin observar els drets humans en les àrees de les seves
respectives responsabilitats polítiques i administratives. Sabem que les
informacions que li estem proporcionant no figuren en l’EPU esmentat del Regne
d’Espanya. Tanmateix creiem que, per justícia, hi haurien de constar, amb les
implicacions pertinents, donat que el dret a l’autodeterminació és essencial a
fi que puguin realitzar-se, en les condicions requerides, els drets relatius a
la pau i la convivència democràtica de tots els éssers humans i els pobles amb
els quals cada un d’ells s’identifiquen. Això és, els drets que constitueixen
els ideals de la mateixa ONU i que són el puntal i la raó de ser del Consell que
la seva Excel·lència presideix. Si aquest punt constés en l’EPU del Regne
d’Espanya, es posaria en evidència que aquest Estat, tot i haver acceptat i
ratificat els Pactes Internacionals de l’ONU que contemplen el dret a
l’autodeterminació dels pobles com a dret fonamental, el nega i el prohibeix al
poble català. És veritat que el govern espanyol justifica la seva posició
al·legant que la Constitució espanyola no contempla aquest dret pel que fa al
poble català, però també és veritat que el mateix govern silencia que aquesta
mancança es contradiu amb el que la citada Constitució estableix quan afirma
que ella és de rang inferior als Pactes internacionals signats i ratificats pel
Regne d’Espanya, on el compromís a favor de la realització del dret a l’autodeterminació
de tots els pobles, sense excepció, hi és ben explícit.

        Creiem que si l’actitud
impugnable del govern espanyol en relació a un dret tan bàsic fos examinada pel
Consell de drets Humans de les Nacions Unides aquest es veuria obligat a exigir
al Regne d’Espanya de ser fidel no tan sols als postulats de l’ONU sinó també
als seus compromisos. En tot cas, un avenç en aquesta direcció significaria un
gran pas en pro de l’aplicació del principi que en la mesura que els drets dels
pobles són respectats, més promoguda i garantida és la pau i la democràcia de
tothom, més tancades resten les vies dels enfrontaments o  conflictes que el no respecte als drets
obren.

        Confiem que la seva Excel·lència farà
tot el possible per tal que el Consell de Drets Humans prengui acte del que li
sol·licitem i es pronunciï responsablement en la perspectiva que li demanem:
seria un gest que, en definitiva, permetria al poble català de no haver-se de
continuar sentint oposat al Regne d’Espanya, perquè els seus drets col·lectius
serien garantits, podria viure com a poble lliure i ben disposat a ser
interlocutor, en un pla d’igualtat, amb tots els altres pobles, comprenent-hi
també, naturalment, el poble espanyol.

         Tot agraint-li la seva atenció i
esperant poder-li agrair personalment la seva cooperació, el saluden, amb la
consideració que ens mereix, en nom de tots els qui ens concentrarem davant la
seu de les Nacions Unides de Ginebra el proper dia 8 de maig

Your Excellency,
 

Having been informed that on May 5th
and 7th 2010 the United Nations Council of Human Rights, over which
you preside, will be informed of the situation of Human Rights in the Kingdom
of Spain, following the rules of the U.P.E., the undersigned respectfully
request you to take the following into consideration:

On May 8th,
a peaceful concentration of Catalan citizens is to take place in front of the
United Nations Palace in Geneva. They will have come from all over the
Catalan-speaking countries and other European countries in order to testify to
the ever-increasing number of compatriots who want their right to
Self-Determination recognized. As the United Nationas has repeatedly
acknowledged, this right is one belonging to all people wherever they are in
the world.  Ever since the United Nations
was established, this will has been made clear on many occasions by way of
successive documents written by representative personalities of our country and
addressed to the United Nations. This desire has also been clearly stated in
decisions taken by the Catalan Parliament. Finally, the same wish was also
expressed in a popular demonstration held opposite the U.N. headquaters in 1985
as it was in other initiatives emerging from Catalan Civil Society. Among these
we must underline the hundreds of unofficial polls carried out in our country
in the last six months, under the close monitoring of dozens of qualified
international observers. This has given rise to a process whereby almost half a
million people have voted in favour of the independence of the Catalan
nation.

We want to make you
acquainted with these facts because we believe they come under the jurisdiction
of the U.N. Council of Human Rights which involves, among other matters,
ensuring that all members of the U.N. promote and observe human rights in
whatever areas their respective administrative and political responsibilities
may lie. We are aware that the information given above does not conform with
the U.P.E. mentioned earlier for the Kingdom of Spain. However, for the sake of
justice, we think they should be stated, with their respective implications,
because the right to self-government is essential for the achievement of peace
and democratic coexistence amongst all human beings and the nations each
identifies with.  In other words, we are
talking about the rights which constitute the U.N.’s own ideals, ones which are
the pillars of the very existence of the Council you preside over. If this were
unmistakably stated in the U.P.E. for the Kingdom of Spain, it would show quite
clearly that it denies and forbids it in Catalonia, despite  having accepted and ratified the
International Agreements of the U.N. which contemplate the Self-Determination
of Nations as a fundamental right.  The
Spanish government justifies its position by alleging that the Spanish
Constitution does not contemplate this right as far as Catalonia is concerned.
But it is also true that the same government omits the mention of the fact that
this is a contradiction since the very Constitution states that its rank is
inferior to International Agreements that have been signed and ratified by the
Kingdom of Spain. In these, the right to self-determination of all nations,
without exception, is very clearly 
stated.


We believe that if the
attitude of the Spanish government with regard to such basic rights were
examined by the Human Rights Council of the U.N., it would be compelled to
insist that the Kingdom of Spain were faithful not only to U.N.’s own
postulates, but also to the agreements it has signed.  In any case, 
progress in this direction would mean a great step towards the
application of the principle stating that the more the rights of peoples are
respected, the more democracy and peace are guaranteed for everyone. It would
also help to curb the confrontation and conflicts that is generated when rights
are not respected. 


We trust that Your
Excellency will do everything in your power to ensure that the Human Rights
Council takes note of our complaint, and that you will make a statement in
favour of our request. It would be a gesture which would enable the Catalan
people to stop finding themselves continually opposed to the Kingdom of Spain
since it would now mean that their collective rights were being guaranteed.
Catalans could now live as free people and would be prepared to take part in
the dialogue between nations, naturally with the Spanish people too.


With our most sincere
thanks for your attention to this matter, and hoping we can thank you
personally for your cooperation in the near future,  with our full respect for your
Excellency,  and in the name of all those
who will gather together in front of the United Nations building in Geneva on
May 8th,  we send you our
greetings.
